Case Summary:
When a senior researcher from Iran wanted to file an EB-2 NIW (National Interest Waiver) petition, she sought North America Immigration Law Group’s help. Our client, who holds a Ph.D. in Metallurgical Engineering, is a researcher in the field of materials science. Her work involves the advanced study of metals and their properties, production, and purification. We knew that in order to convince the USCIS to approve our client’s EB-2 NIW petition, we had to prove that her work directly benefits the United States. Our presentation of her case focused especially on benefits to the country’s energy sector.
In our client’s petition, we included detailed accounts of her professional record, such as her citation count and publication record. We also demonstrated that all her past and present achievements are not easily attainable, even by other researchers with similar skillsets. As part of our services, we helped our client contact experts in her field to obtain letters of support for her EB-2 NIW petition. One such letter read, in part, “It is clear that [Client’s] research is valuable, practical, and innovative. The fact that she is working in a specialized field only increases the need to retain her, as it would be an extraordinarily difficult task to find others who match her abilities.”
The approval of our client’s I-140 more than 11 months later is a clear indication that the USCIS agreed with our presentation. The lengthy processing time occurred in part because of the Request for Evidence (RFE) that the USCIS issued soon after we raised a service request. We rapidly extinguished all doubts that the USCIS had regarding our client’s credentials, and several months later, they approved our client’s I-140, propelling her one very large step closer to her green card.
