Case Summary:
In this case we had the opportunity to take a civil engineering staff professional specializing in geotechnical engineering from South Korea as our client. We argued, and successfully demonstrated, that his continued employment in the field would be of benefit to both the field as a whole and the people of the United States at large. He had produced 5 peer-reviewed journal articles, which had been cited a total of 24 times when we filed the case, indicating that our client’s work is widely recognized and relied upon in his field. He had also been consistently invited to present at acclaimed international conferences and to review manuscripts for leading journals in his field. An independent recommender provided a testament to the importance of his work: “[Client] has developed a novel groutability criterion for particulate grouts that is founded on extensive experimental work and a theoretical filtration model. Most importantly, this work represents a completely innovative approach to the improvement of granular soils that can find application in many different settings, including in the mitigation of the effects of earthquake induced liquefaction, a geo-hazard that has been responsible for loss of lives and enormous damage to structures, transportation systems and lifelines in all recent earthquakes. This work, lies at the interface of geotechnical engineering, chemistry and material science, and represents a truly novel contribution to our field.” Through extensive documentation, we were able to successfully argue that our client would serve the national interest to a significantly greater degree than others with similar education and experience. His NIW petition was approved in four months and seventeen days.
