Case Summary:
At a glance, our client’s Ph.D. in Optics and his extensive experience made him a perfect candidate for EB-1A (Alien of Extraordinary Ability). However, our strict protocol required us to conduct a thorough evaluation of his credentials before initiating the attorney-client contract. Unsurprisingly, we concluded that our client’s I-140 petition should be filed under EB-1A.
Our Well-Developed EB-1A Petition Packet:
Our EB-1A petition was composed of our client’s copious professional and academic achievements. We documented his publication record (10 scientific articles, a book chapter, and 10 conference proceedings), his citation count (nearly 300 citations), and his peer review experience (20 reviews conducted for various scientific journals). We further fortified our petition by including testimonials that our client had gathered from other leaders in his field of biomedical optics. We used these letters to support our argument that our client is an asset to the United States and that his research efforts significantly impact multiple progressive areas that benefit the nation. One of our client’s recommenders—a distinguished professor—agreed with our summation. He wrote, “His work is applicable in not only a variety of different branches of his field, but also in several other fields of scientific research. Specifically, [Client] has advanced the ability of those in the healthcare system to effectively detect and treat cancers, and he has developed advanced new technologies and methods for biomedical imaging.”
In Conclusion:
We have no doubt that our client’s impressive credentials and our carefully compiled EB1A presentation paved the way for petition approval. Due to Premium Processing, this happened in merely 12 days. Case Summary:
North America Immigration Law Group (WeGreened.com) had the pleasure of working with a gifted Chinese research scientist immersed in the field of plasma physics. He hired us to help him get one step closer to a green card. After evaluating his credentials, we concluded that the best way to do so would be via EB-2 NIW (National Interest Waiver).
EB-2 NIW Petition Dossier:
Our job was to compile a wealth of information on our client’s various accomplishments and turn what we had into a convincing EB-2 NIW presentation. We noted everything from our client’s Ph.D. in Electrical Engineering to his current research on the interaction between the magnetic field and plasma flow in astronomical structures. We summarized everything we learned and demonstrated to the USCIS that not many other physicists with similar skillsets can attain the same level of research success. We also proved that our client’s work is important to the United States, particularly when it comes to the country’s development of thermonuclear technology and advancement of fusion research. To pad our NIW petition packet, we included additional evidence that illustrated our client’s high standing in his field: the 36 citations to his 7 publications, and recommendation letters furnished by other expert physicists, all of which firmly demonstrated that our client’s opinions and insights considerably progress the work of other scientists. Here are several quotes that we excerpted from three of the six recommendation letters that our client obtained:
“[Client’s] impressive background and training have shaped him into a researcher with a unique perspective that allows him to conduct research geared heavily towards practicality and usability. I simply do not believe that the research community in the U.S. could have advanced as far as it has in its understanding of plasma without [Client’s] diligent work, and many continue to rely upon his insight and skills today.”
“The culmination of all of this academic work, and his experimental designs and applications, indicates that [Client] is truly an expert on dynamos and an important researcher in physics and electrical engineering. He has rapidly gained influence in this crucial field, and I highly encourage you to provide him with the support he needs to continue his novel research.”
“Given this highly successful work, I certainly expect [Client] to continue making substantial contributions to the field. Considering that he has already vastly outstripped even the most ambitious goals for a researcher in this field, it is plain to see that we can expect only the best from [Client] in the years to come.”
Story of Success:
We are pleased that Texas Service Center approved our client’s NIW petition (in 5 months and 2 days), and that we get to chalk it up as yet another encouraging example of our firm’s determination to help every client get closer to permanent residency. Our client now has to wait for his priority date to become current before filing his I-485 application (final step in green card proceedings). When the time comes, we look forward to helping him obtain his green card. Till then, we wish him well with his continued research ventures.

Case Summary:
A materials engineering expert approached North America Immigration Law Group (WeGreened.com) to help attain green cards for herself and her family. Based on her qualifications, the best way to do so was via EB-1A (Alien of Extraordinary Ability). As soon as she signed and returned the contract to us, we got to work putting together a strong EB-1A case on her behalf.
Case Details:
By the time we were ready to file the case, we had compiled much information on our client’s copious accomplishments. From her educational background to current research projects, we covered it all. Here is what we learned:
  • Our client earned her M.Sc. and Ph.D. in Polymeric Materials from universities in her birth country of China. These advanced degrees proved to the USCIS that she is more than capable of carrying out her current duties as a lead research and development director. We also demonstrated that she is well-equipped with the knowledge needed to continue conducting outstanding research in her field of materials engineering.
  • Amongst other things, our client’s research focuses on polymer processing and functionalization, resolving equipment shortage issues, and the development of environmentally friendly and high performing coating solutions. We demonstrated that her work advances the United States’ efforts to produce cost-effective and environmentally sound synthetic materials that are central to the operation of everyday lives. Our client’s in-depth research has led to 52 published papers, one book chapter, and several patents. Furthermore, her work has collected over 800 citations, and she has conducted 9 peer reviews for several scientific journals.
Although we had amassed enough information to present a strong EB-1A case to the USCIS, we needed to ensure that the case was airtight. We prompted our client to connect with prominent materials engineers whom we helped select, and ask them for recommendation letters. Our client returned with five strong letters, all of which verified our claim that our client’s work is essential to the United States and that it progresses the work of other researchers. Here is a quote taken from one of these letters: “[Client] is a gifted individual […] I have unwavering confidence in her research abilities and affirm that her work is of great scientific merit and use for a wide variety of applications that are assuredly not confined to polymeric materials and chemical industries. Bearing this mind, it is imperative that the United States retains a researcher of such an exceptional caliber.”
Final Step towards a Green Card:
Thanks to Premium Processing, Texas Service Center only spent 11 days adjudicating our client’s EB-1A petition. Without wanting to waste any time, our client retained our services to help her file I-485 applications (last step in green card proceedings) for herself and her family. We join them as they eagerly await a positive decision from the USCIS.

After evaluating her qualifications, we approved her request to file her I-140 petition under the EB-1A (Alien of Extraordinary Ability) visa category. Because our client elected to file her petition using the Premium Processing option, we received an approval notice merely six days after the petition was filed.
Seeing that EB-1A petitions are held to a very high standard of law, we had to ensure that our presentation was flawless and clearly demonstrated the value of our client’s work to the United States. Amongst other things, we listed her citation count (nearly 300 citations), publication record (35 published papers), and peer review experience (40 reviews). We also detailed the fact that our client served as an editorial board member for two prominent scientific journals at the time of filing. Besides listing our client’s professional triumphs, we also noted her scholarly achievements: her Ph.D. obtained from a university in her birth country of China and a copy of her degree.
Additional Evidence:
We used recommendation letters endorsed by other expert pharmacologists as additional evidence to strengthen our EB1A petition packet. These letters supported our claim that our client’s work on epigenetic pharmacology and pain pharmacology—with a particular emphasis on tumor epigenetic therapy and chronic pain targets—are of great value to the United States. According to one of our client’s recommenders, “The work conducted by [Client] is an amazing achievement in cancer epigenetic studies and puts the field ever-closer to eradicating myriad cancers. Our inquiries could not be unfolding at better time, as cancer is still responsible for 8.2 million deaths worldwide and new cases of cancer are expected to surge up to 22 million within the next two decades.” Another prominent member of the field stated, “I am unaware of anyone more qualified than [Client] undertaking research that is so central to understanding and eradicating chronic pain for the nerve—injured. Chronic pain remains a primary cause of long—term disability, keeping individuals from working or otherwise enjoying their lives to the fullest…”

Case Summary:
This EB-1A (Alien of Extraordinary Ability) case involved a postdoctoral research associate from China. He hired North America Immigration Law Group when he decided that he wanted to become an American permanent resident. Once an attorney-client relationship arose, our legal team got to work putting together a strong EB-1A petition on his behalf.
One of the first things we did was help our client select experts in his field who could contribute recommendation letters in support of our EB1A petition. Our client persuaded these experts to furnish us with testimonials, and the six letters that he gathered served as additional proof that his work is relevant to the United States, particularly its medical sector. Here are a couple of quotes that firmly supported our argument:
  • “Without [Client's] sustained participation in his research, I anticipate costly delays in scientific progress in the field as a whole. His impressive background and experience in research settings has shaped [Client] into a researcher with a unique perspective and background that allow him to conduct research geared heavily towards practicality and usability. I simply do not believe that the international research community could have advanced as far as it has without [Client's] diligent work, and we continue to rely upon his insight and skills today.”
  • “[Client] has made major advancements to the scientific understanding of the world around us in a way that few other researchers have. Furthermore, he has also opened new avenues for scientific inquiry, thereby influencing scientific research well beyond the confines of his own field. For these reasons, it is clear that [Client] must be allowed to continue his work in the United States.”
Our well-prepared EB-1A petition also contained details of our client’s research on functional and X-ray structural studies of membrane and cytosolic proteins as they pertain to cell death and cell communication. These details were accompanied by his peer review, citation, and publication count, which at the time of filing stood at 30 reviews, 173 citations, and 6 publications. Thanks to Premium Processing (PP), our client received an approval notice merely eight days after we filed the case on his behalf. By paying an additional $1,225 to the USCIS, petitioners who opt for PP will receive a decision in 15 days as opposed to 4-9 months.
Overall, we handled all aspects of communication with the USCIS, leaving our client time to focus on his research in the field of molecular biology. We congratulate him on receiving a highly sought after EB1A approval, and we wish him well as he embarks on the final leg of the green card journey: the I-485 application.

With a Ph.D. in Biophysics and Computational Biology and various research projects focused on the molecular mechanisms and pathways of membrane transport proteins, our client had the credentials to file his I-140 petition under EB1A, which has a very high standard of law. We worked diligently to put together a strong EB-1A petition packet that highlighted his talents. Our presentation contained the following:
  1. Publication & Citation Record: When we filed the case, our client’s work had gathered 160 citations. Furthermore, he had already published 10 scientific articles and three book chapters.
  2. Encouraging Testimonials: When we first took on our client’s case, we prompted him to touch base with other influential researchers in his field and request for recommendation letters. We needed third-party opinions on the value of our client’s work to the field, and approaching fellow biophysicists was the best way to do it. Our client managed to obtain six recommendation letters, one of which stated, “Overall, these achievements of [Client] are indicative of a researcher who has reached the top of his field and is likely to continue in his path of success. Because of this, he is a great asset to the scientific community of biophysics and computational biology researchers in the United States and therefore he should be permitted to persist in his research efforts.”

Overall, the USCIS only spent 6 days adjudicating our client’s EB-1A petition before granting their approval. The compressed timeline had to do with the fact that our client chose to file his case under Premium Processing (immigration officers must take action on PP cases within 15 days as opposed to 4-9 months for regularly filed petitions). We congratulate our client on receiving an approval notice, and we wish him well as he continues to progress his field of biophysics.

Success Stories: Premium Processing Allows Postdoctoral Research Associate in Illinois in the Field of Molecular Biology to Receive EB-1A Approval in 6 Days

Client’s Testimonial:
“I am happy to inform you that my I-140 EB1A was approved on 16th March. Thank you so much for your excellent help.”

On March 16th, 2016, we received another EB-1A (Alien of Extraordinary Ability) approval for a Postdoctoral Research Associate in the Field of Molecular Biology (Approval Notice).

General Field: Molecular Biology
Position at the Time of Case Filing: Postdoctoral Research Associate
Country of Origin: India
Service Center: Nebraska Service Center (NSC)
State of Residence at the Time of Filing: Illinois
Approval Notice Date: March 16th, 2016
Processing Time: 6 Days (Premium Processing Requested)

Case Summary:
North America Immigration Law Group (WeGreened.com) helped a talented postdoctoral research associate from India file two I-140 petitions: one under the EB-2 NIW (National Interest Waiver) visa category, and the other under EB-1A (Alien of Extraordinary Ability). It is not unusual for our clients to file two petitions at the same time as it increases their chances of getting an approval. In this case, our client’s EB-1A petition was approved whereas his EB-2 NIW petition is still pending approval. We are pleased that our client obtained an EB-1A approval because now, he does not have to wait for his priority date to become current before partaking in the second and final step of the green card process: the I-485 application.
‘Current’ Priority Date:
The USCIS has a strict quota system in place that restricts the number of green cards granted to applicants with EB-2 NIW approvals who were born in certain countries (India is one of them). As our client was born in India, he would have to wait several years for his priority date to become current if he chooses to apply for a green card based on an approved NIW petition. However, seeing that there is no quota in place for the EB-1 visa category, our client may file an I-485 any time he wants with his EB1A approval.
Our Winning EB-1A Petition:
Our job was to compile as much information as we could on our client’s professional accomplishments and put together a strong EB-1A petition packet. Our presentation was composed of our client’s eight publications, the 91 citations to his work, and the 21 times he conducted peer reviews for a number of acclaimed scientific journals. We also detailed his research projects related to heart failure, as well as investigations linked to other aspects of the human body. Based on everything we gathered, our petition packet demonstrated to the USCIS that our client’s work is important to the United States. To bolster our presentation, we incorporated recommendation letters signed by other expert molecular biologists, one of whom firmly stated, “There are few scientists capable of equaling both the sheer volume, and caliber, of [Client’s] career. I am confident in stating that he could not be replaced, and that the field of biochemical research would suffer without his presence.”
In Conclusion:
We would like to congratulate our client for surpassing this significant milestone in the long journey towards a green card. We wish him well with his I-485 application and thank him for choosing our firm to represent his EB-1A and NIW petitions.
Premium Processing:
Largely due to Premium Processing (PP), our client received an EB1A approval notice from the USCIS just six days after we filed the petition on his behalf. By paying the USCIS an extra $1,225, petitioners whose cases are filed under PP get to enjoy speedy processing: within 15 days instead of 4-9 months.

We also encouraged our client to touch base with other influential researchers in her field and request for recommendation letters. She did not disappoint, and managed to gather six testimonials that confirmed the importance of her research on neurological diseases. Using these letters and the myriad of information we had gathered, we demonstrated to the USCIS that our client’s investigations significantly impact the United States medical system as well as various other scientific fields aside from her own. According to one of her recommenders (a distinguished professor at one of the country’s top universities): “The fact that [Client’s] work is applicable in so many fields has made her scientific discoveries important and influential around the world and distinguished her among her peers as a researcher at the top of her field, whose absence in the scientific community of biomedical researchers in the United States would be detrimental to further progress.”
Premium Processing:
Like many of our EB-1 clients, this fellow opted to file her case under Premium Processing (PP) as it allowed her to shorten the overall time spent waiting for the USCIS to make a decision. In this case, she received an approval notice within 6 days (it takes the USCIS between 4-9 months to take action on I-140 petitions filed under regular processing). Although it costs $1,225 more, PP is a good option for petitioners who are reluctant to wait several months for the USCIS to deal with their case.
Final Step:
Our client chose to file her I-485 application using our D.I.Y. Packet (only available to clients who retained us for their I-140 petition). This packet contains clear instructions on how to file an I-485 application. We wish our client the best with this, and we look forward to receiving an update from her regarding her application.

North America Immigration Law Group (WeGreened.com) was hired to help a postdoctoral research associate from Kenya get his I-140 petition approved. Here are the several stages that we went through before emerging victorious on the other side with an approval notice from the USCIS.
  1. Evaluation: Before initiating the attorney-client relationship, we carefully evaluated our client’s credentials to establish if he qualified for a green card. Once we determined that he possessed the necessary credentials, we conducted further evaluations to determine which visa category to file his I-140 petition under. In this case, we decided to file our client’s petition under EB-2 NIW (National Interest Waiver).
  1. Gathering Recommendation Letters: Once our client had signed and returned the contract to us, we helped him narrow down a list of potential recommenders who could provide us with strong testimonials. We made sure that the elected recommenders were influential experts in our client’s field of physical chemistry. The six recommenders whom we selected all agreed to lend their support, and the recommendation letters that they signed off on were incorporated into our well-balanced EB-2 NIW petition packet. These letters furnished the USCIS with proof that our client’s work on gas phase chemical dynamics and spectroscopy is of great importance to the United States.
  1. Compiling Evidence: As with any legal case, we had to ensure that we had sufficient proof to argue our stand that our client deserved to get one step closer to permanent residency. We used Google Scholar to determine the total number of citations to our client’s work (37 citations) and established that he had published a dozen scientific papers. We used these figures, along with additional evidence that we had gathered, to convince the USCIS that our client’s investigations contribute to the American combustion industry, specifically in terms of furthering the nation’s understanding of various environments, such as those found in soot-forming processes. Our NIW petition also included a copy of our client’s Ph.D. in Chemistry and its corresponding transcripts—to prove that he is equipped with the theoretical knowledge and skills to conduct outstanding research.
  1. Refining and Submitting the Petition: After several months of carefully compiling everything we needed to present a strong case to the USCIS, we prepared a well-worded petition letter to summarize all of our findings. We then submitted the comprehensive NIW petition packet on our client’s behalf and waited for a verdict from Texas Service Center. As is clear from the publication of this success story, they approved our petition.
We would like to congratulate our client for surpassing this significant hurdle in the green card journey, and we wish him and his family well as they embark on the final portion of the journey towards permanent residency.

Success Stories: NIW Petition Approved for Iranian Assistant Professor in North Carolina in the Field of Control Systems Engineering

Client’s Testimonial:
"Thanks for the update."

On March 11th, 2016, we received another EB-2 NIW (National Interest Waiver) approval for an Assistant Professor in the Field of Control Systems Engineering (Approval Notice).

General Field: Control Systems Engineering
Position at the Time of Case Filing: Assistant Professor
Country of Origin: Iran
Service Center: Texas Service Center (TSC)
State of Residence at the Time of Filing: North Carolina
Approval Notice Date: March 11th, 2016
Processing Time: 8 months, 5 days

Case Summary:
A prominent assistant professor from Iran hired North America Immigration Law Group (WeGreened.com) to help him attain a green card via EB-2 NIW (National Interest Waiver). As soon as an attorney-client relationship arose, we got to work building a strong NIW case for our client. Here are some of the most important things our petition focused on:
  1. Value of Work: Using Google Scholar and similar references, we established that our client’s work had earned 89 citations and that he had published half a dozen journal articles, 1 monograph, 1 book chapter, and numerous conference papers. We also noted the 17 times he conducted peer reviews for scientific journals and conferences. Not only did we demonstrate the value of our client’s research findings to other researchers in the field of control systems engineering, we also demonstrated the value of his work to the United States as a whole, particularly the country’s space exploration efforts, military, healthcare, and transportation technologies.
  2. Research Topics: We carefully reviewed and outlined our client’s development of control systems for use in autonomous vehicles. By understanding the core of our client’s research, we were able to argue its significance to the research community as well as to the United States. We also convinced the USCIS that only a handful of other researchers can attain such meritorious research results.
  3. Support from Peers: Third-party support played a crucial role in our presentation. We started off by helping our client narrow down a list of possible recommenders who could attest to the usefulness of his work. We then urged our client to contact these people—all of whom are experts in the field—and request for recommendation letters. Our client obtained five letters, one of which described his work as “… truly impressive.” Another recommender stated that “ […] [T]he ongoing nature of space exploration, environmental modeling, unmanned surveillance, and the heightened risks posed by climate change, international terrorism, and so forth, make [Client’s] work imperative to this country for many years to come.”
Our presentation of our client’s strong credentials and significance of his work to the United States persuaded the USCIS to approve his EB-2 NIW petition. We are extremely pleased at the outcome and would like to congratulate our client for overcoming such a significant hurdle. We now shift our attention towards the final step of the green card process. As our client chose to file I-485 applications for himself and his wife while his NIW petition was pending approval, we estimate that the USCIS should make a decision on their I-485s soon. Once those are approved, our client and his wife will become permanent residents. We join them as they await optimistic news.

Success Stories: EB-1A Petition Approved for Postdoctoral Research Fellow from China in the Field of Pharmacology

Client’s Testimonial:
“Thank you so much for your help…”

On March 14th, 2016, we received another EB-1A (Alien of Extraordinary Ability) approval for a Postdoctoral Research Fellow in the Field of Pharmacology (Approval Notice).

General Field: Pharmacology
Position at the Time of Case Filing: Postdoctoral Research Fellow
Country of Origin: China
Service Center: Texas Service Center (TSC)
State of Residence at the Time of Filing: Texas
Approval Notice Date: March 14th, 2016
Processing Time: 20 Days (Premium Processing Requested)

Case Summary:
Largely thanks to Premium Processing (PP), this postdoctoral research fellow from China received an EB-1A (Alien of Extraordinary Ability) approval in just 20 days. It would have taken him between 4-9 months to receive an approval notice had he not upgraded his case to PP—which our legal team did on his behalf a week after it was initially filed.
North America Immigration Law Group (WeGreened.com) worked diligently to put together a strong EB-1A petition packet for our client. Plenty of attention to detail was paid, and the resulting petition was composed of a myriad of information related to our client’s various academic and professional triumphs. These included the 207 citations to his work, his 8 published papers, and the 50 times he assessed the work of his peers for high impact scientific journals.
Our petition packet also contained six recommendation letters provided by other prominent pharmacologists, all of whom had either worked with our client or had used his research findings to advance their own investigations. One of our client’s recommenders had this to say about his work: “Clearly, his work has proven to be so essential to the development of further progress in signaling mechanisms that it is already being used to develop new drugs. [Client’s] work is also important to cell and molecular biology […] I believe that it is in the best interest of the U.S. to maintain his presence in the country so as to ensure the use of his talents for growth of this sector. All these facts affirm [Client’s] place as one of the most significant contributors to his field in recent history, and suggest his ability to continually produce vastly impactful work.”
Final Step in the Green Card Process:
The final step towards a green card involves filing an I-485 application. We recently filed these applications for our client and his spouse, and we join them as they eagerly await a favorable outcome from the USCIS. We would like to thank our client for selecting our firm to represent his case, and we wish him well as he continues to progress his field of pharmacology.
