A postdoctoral researcher from Taiwan recently received news that both her I-140 petition and I-485 application (the two steps in the green card process) were approved. She is now an official American permanent resident.
The EB-2 NIW Case:
After carefully evaluating our client’s qualifications, we asserted that she should file her I-140 petition under the EB-2 NIW (National Interest Waiver) visa category. Here are some reasons why our client qualified for the national interest waiver:
  • Outstanding Research: Our client’s work in the field of oncology focuses on uncovering the underlying molecular and genetic causes of several key types of cancer—prostate, cervical, endometrial, colon, liver, and brain cancer. We argued that her research findings benefit modern medicine and biomedical investigations, and that they have led to important advances in applied cancer research. Furthermore we convinced the USCIS that our client’s work advances the United States healthcare industry.
  • Notable Citation & Publication Count: When we filed our client’s NIW case, her 10 published journal papers had amassed 109 citations.

As our client chose to file her I-485 while her I-140 was pending, she received the I-485 approval notice less than two months after the first approval.
