Case Summary:
A talented postdoctoral researcher from India recently received the good news that his EB-1A (Alien of Extraordinary Ability) petition had been approved. He can now move on to the final phase of the green card process and file an I-485 application. Once that is approved, he and his dependents will obtain American permanent residency.
Our client initially sought our help to file an EB-2 NIW (National Interest Waiver) petition. Upon receiving the approval notice, he decided that he wanted to try for an EB-1A petition approval. Getting an EB1A approval would mean not having to wait for his priority date to become current to file an I-485 application. Applicants born in India whose I-140 EB-2 petitions were recently filed and approved currently have to wait several years before they can move on to the I-485 step. On the other hand, applicants with EB-1 approvals may proceed immediately.
As we were tasked with putting together a strong EB-1A petition for our client, we were sure to leave no stone unturned. We went to great lengths to carefully review our client’s various research projects on advancing treatments for pathogens and various infectious diseases. Based on what we learned, we determined that our client’s work is crucial to the advancement of the American medical and healthcare sector. We supported this argument by utilizing information gleaned from recommendation letters gathered from other experts in the field of immunology. These specialists verified the value of our client’s research to the nation, and we used their expert opinions to help us strengthen our case. For instance, one of these experts wrote, “[Client’s] research is bringing the medical sector much closer to producing next-generation vaccines that have been unattainable thus far. His rotavirus assessments have highlighted important variables to consider when combating this critical pathogen. Therefore, [Client’s] work is largely benefitting the medical and pharmaceutical industries in the United States.”
Besides the incorporation of strong recommendation letters and details of our client’s research efforts, our EB1A petition dossier was also composed of data on our client’s 20 scientific articles and 2 book chapters, the 125 citations to his work, and the 9 reviews he conducted for well-known scientific journals.
Premium Processing:
Thanks to Premium Processing, our client obtained an approval notice from Nebraska Service Center merely eight days after we filed the EB1A petition on his behalf. We are pleased that our client is now significantly closer to permanent residency. He recently opted to file his I-485 application with the help of our D.I.Y. Packet (only available to clients who engaged our I-140 services). We wish him the best with this and thank him for selecting us to represent both his NIW and EB1A petitions.
